In October of 2005, the U.S. bankruptcy laws underwent some major changes. Having a lawyer on your side that is fluent in the language of the new bankruptcy code is beneficial to your finances and your future.

The most important changes to the law involve and income level analysis or "means" testing. I can evaluate your case to see if, based on your income, you could qualify for the simplest and least expensive kind of bankruptcy, a Chapter 7. If you do not qualify for Chapter 7 but still need to file for bankruptcy (say, for example, your house is being foreclosed, and you want to save it), you can still usually qualify for a Chapter 13 bankruptcy. In Chapter 13, you pay back all or part of your debt over a period of three to five years.

Chapter 7

If you pass the "Means Test," you may qualify for the least expensive and simplest form of bankruptcy, Chapter 7. Also sometimes called a fresh start, a Chapter 7 bankruptcy allows you to discharge most of your unsecured debt without having to pay it back.

When handling Chapter 7 matters, I offer flat fee representation. This means I will give you price for my services up front. Though I am flexible with how my clients want to pay, it is important to note that I must be paid in full before the case is filed to prevent me from becoming one of your creditors as well.

Chapter 13

If your house is being foreclosed upon or you do not qualify for a Chapter 7, Chapter 13 bankruptcy may be the option for you. Through this type of bankruptcy, some of your debt may be discharged but you pay back other debts according to a court-approved repayment plan. This allows you to make good on your debts while regaining a handle on your finances.
